General Conditions

 

This service terms are applicable to the sales and orders processed and made in the SPRY online store www.spry.pt, by its consumers and clients.

 

All items acquired in SPRY online store www.spry.pt are subject to the Portuguese legislation.

 

SRPY online store is run and administered by FFH - FITNESS FASHION HUB, IMPORTAÇÃO, EXPORTAÇÃO E COMÉRCIO, LDA., a Portuguese company with the fiscal number 514458984, with Headquarters in Avenida Almirante Reis, n.º 48, 1.ºEsq., 1150-019 Lisboa.

 

The products on sale at SPRY online store and directed solely to be sold to final consumers or users, for own use.

 

SPRY reserves the right to cancel and not process any order from non-consumer entities or any other order that does not comply with this service terms.

 

All SPRY online store users must be over 16 years of age.

 

All the products sold on SPRY online store www.spry.pt remain the property of the seller until fully paid and delivered to the final consumer.

 

 

Order processing and delivery

 

To be able to order and by products in SPRY online store www.spry.pt, the consumer must create a login client name, provide and email address and allow the cookies and pop-ups used by the store in their web browser, to be able to fully use and benefit the online store.

 

To fully conclude an order in SPRY online store, the consumer shall:

1- Find the items that they intend to buy in the store.

2 – Add send items to the shopping basket or its equivalent.

3 – Finalize the order, entering the delivery information and any other information requested by SPRY online store www.spry.pt.

4 – Select the payment option.

5 – Confirm the order and payment.

6 – Receive the order confirmation in the email address provided.

 

If SPRY online store www.spry.pt is not able to process the order, by any reason, SPRY will send the consumer an email confirming that the order has not been placed, explaining the reasons that originated such problem.

 

If the order does not comply with SPRY online store www.spry.pt service terms, or if the order is signaled by our security services as fraud, spam, phishing, or any other form of abuse of the service terms, SPRY reserves the right to cancel and not process the order, even after confirmation is given by email.

 

By filling in the order form the consumer is agreeing to comply with SPRY online store www.spry.pt service terms and conditions.

 

If SPRY online store www.spry.pt is not able to confirm the payment of the orders, the contact information is incorrect or incomplete, or the products ordered are not available anymore, the order will not be processed and the consumer shall receive and email in the address provided informing that the sales contract is not concluded and the respective reason for such.

 

If, in any case, the order is processed and concluded, and the products ordered are not available for delivery, SPRY online store www.spry.pt will refund the customer with the amount paid for such products.

 

Even after being accepted and confirmed, SPRY online store www.spry.pt reserves the right to cancel any orders:

  • If the billing information is incorrect, incomplete or unverifiable.
  • If the order payment is not processed withing 5 working days.
  • If SPRY online store spry.pt suspects that the consumer is younger than 16 years old.
  • IF SPRY online store spry.pt suspects that the consumer is a reseller, or buying products with the intend to resale them.
  • IF SPRY online store spry.pt suspects that order may constitute fraud or make SPRY online store www.spry.pt liable to any king of damage.
  • If delivery in the address provided is impossible.
  • If there is an error in the displayed price of a product.

 

SPRY online store www.spry.pt only accepts the payment methods indicated specifically on the store webpage and will no process any order made with any other, non-authorized method of payment.

 

SPRY online store www.spry.pt will not be liable for any damage the consumer may incur by using any other method of payment not authorized by the store webpage and will not refund any payment that does not comply with this service terms.

 

All payments will be processed as soon as the order is confirmed and leaves our warehouse for delivery.

 

The data provided in payments made by credit/debit card, as the card number, holder name and expire date, will be sent by and encrypted protocol by the company that provides electronic payment services to the SPRY online store www.spry.pt. This information will not be used by SPRY online store except to process order payment and refunds, and will be shared with law enforcement authorities, in cases of fraud or criminal intent.

 

The price of the products sold in SPRY online store www.spry.pt are shown in EURO (€) as the final price for the consumer in Portugal, including the Portuguese legal VAT (IVA) tax.

 

The shipping costs may vary with the destination country and will be added to the final price, in the order processing form, before payment and confirmation.

 

In the case that SPRY online store www.spry.pt offers free delivery of the order, if the first delivery attempt is not successful, the further attempts will be subject to shipping costs , whose payment will be charged to the consumer.

 

All the products in SPRY online store www.spry.pt are subject to price changes, in any given moment, without any prior notice.

 

The price shown at the time of order placement and confirmation will be the price of the product in that order, and will not be changed after the order is placed and confirmed.

 

All the orders placed in SPRY online store www.spry.pt will only be delivered if the consumer address is situated in country listed in the following list:

  • Europe,
  • United States of America
  • Canada
  • Australia

 

 

The delivery date of the orders placed in SPRY online store www.spry.pt may change due to the transport company policies and should be confirmed directly by the consumer with such provider.

 

The delivery will only be considered completed if the receiver signs a delivery receipt.

 

 

Whenever possible, SPRY online store www.spry.pt will try to deliver all the items in one or more simultaneous orders in just one shipping. However, SPRY online store www.spry.pt reserves the right to split the order or orders in multiple shippings if only some of the products are delayed or temporarily unavailable. If SPRY online store www.spry.pt does split the shipping of an order, the consumer will receive and email informing of such in the address provided in the order placement.

 

 

Quality and Warranty

 

SPRY online store www.spry.pt does not sell second hand products, or any defective or lower quality products.

 

The main characteristics of the products are shown in the products page.

 

The products sold in SPRY online store www.spry.pt may not match exactly the image, size and color of the real products delivered to the consumer, due to color display specifications in the web browser, operating system, and display device used by the customer to place the order.

 

 

Refund, exchange, and damaged products Policies

 

Conditions

SPRY accepts Exchanges/Refunds of items, within the deadline mentioned below and according to the store in which the items were purchased.

For a successful Exchanges/Refunds, the item must be delivered in its perfect condition (without being used, washed or with odors), in the same way as it was sold and accompanied by its invoice, labels, etc.

SPRY doesn’t accept Exchanges/Refunds if items were altered, washed, used, or otherwise damaged.

SPRY doesn’t take responsibility for the misuse of items or for incorrect washing steps, please always check Wash & Use instructions.

Before each purchase, we recommend consulting the Size Guide.

Any exchange related to exclusive online items will have to be made through the online store, being the value of the shipping costs at the expense of the customer.

 

Online Store

According to Decree-Law no. 24/2014, of February 14, the customer has 14 consecutive days after receiving the order to proceed with an Exchange or apply for a Refund.

The reasons why customers may request an exchange or refund, in the above-mentioned period are as follows:

  1. The article is big to me;
  2. The article is small to me;
  3. I do not like the item;
  4. I changed my mind;
  5. The item is not as I imagined;
  6. I received the wrong item*.

* If you receive the wrong item, we apologize for what happened and ask to please contact our customer support team as soon as possible to info@spry.pt, so we can rectify the situation.

If the exchange is by a defect of one of the items, see the point Damaged/Faulty.

In online Exchanges/Refunds, all costs of shipping are from the responsibility of the customer. It is advisable that the items be sent to us by courier or registered mail.

Exchanges in the online store www.spry.pt are restricted only to the existing stock at the time of the Exchange.

We do not make reservations and for this reason, the item will only go out of stock at the time the exchange takes place. The exchange will only take place when we receive the item at our facility and it successfully passes our quality control.

The online customer support team undertakes within two working days after receiving the item in our facilities to respond to the customer.

 

Online Exchanges/Refunds Procedure

  • Exchanges:

Once the item reaches our facilities and successfully passes our quality control, we will contact you by email to let you know if the item you have chosen to exchange is available. If so, we will soon send our IBAN to pay the shipping costs and the difference of values between items (if the chosen item is more expensive than the previous one). Once we receive your proof of payment, the new item will be sent to the address indicated on the previous order.

If the chosen item is already sold out at the time of the exchange, you can choose other items available for immediate purchase on our site.

  • Refunds:

As soon as the item arrives at our office, it will be submitted to SPRY quality control and, if it passes successfully, we will send an immediate email requesting the IBAN for which the customer wishes to receive the refund of the order value. The refunds have a deadline of 10 days to be made after receipt of the item in our facilities.

When exchanges are shipped outside the European Union, SPRY is not responsible for delays and customs costs. These are the responsibility of the customer.

 

How to make Exchanges/ Refunds Online 

  1. Send your item along with the invoice to Praça Duque de Saldanha C. C, Atrium Saldanha Loja 38 Aquacare, 1050-094 Lisboa (This address is not open to the public).
  2. Send an email to info@spry.pt with the following information:
  • Full name
  • Email for which you want to be contacted
  • Phone number
  • Address where you want to receive your new item
  • Invoice number and date
  • Reference and size of the item you want to exchange or return
  • Reference and size of the article you wish to receive or indication of return if you wish.

 

Damaged/Faulty

If you purchased a damaged item at SPRY online store www.spry.pt, we apologize right away.

SPRY makes no arrangements unless it is confirmed to be a manufacturing defect. If the arrangement is not possible SPRY undertakes to refund the value of the item to its customers.

SPRY is not responsible for the misuse of your items or for the incorrect washing of the same.

If your item is damaged you can return it as follow:

  • Return by Carrier/Courier

If you prefer to return by Carrier/Courier, the procedure is as follows:

  1. a) Send an email to info@spry.pt with the following information:
  • Full name;
  • Contact email;
  • Telephone number;
  • Number and date of the invoice;
  • Reference and item size;
  • Description of the defect;
  • Explicit defect photographs.
  1. b) The photos sent and the description of the defect will be analyzed by the quality control team. If it appears to be a manufacturing defect, the Customer Support team will contact the customer to have the item shipped to our facility (without associated costs).
  2. c) Upon receipt of the item at our facilities, the defect will be reviewed again by our quality control team, who will contact the customer within 4 business days.

If it is confirmed to be a manufacturing defect, the Customer Support team will inform the estimated time for the arrangement or, if applicable, the refund of the amount paid for the item.

If it is confirmed that the defect was due to a bad use of the customer, SPRY does not accept the return or does the arrangement. The customer is responsible for the costs of sending the item back.

 

Privacy policy

Our webpage is governed in accordance with the General Data Protection Regulation (in English: General Data Protection Regulation or “GDPR”), (Regulation (EU) 2016/679), which is a directly binding legislative act.

The client, consumer or user of SPRY online store shall provide SPRY with an email address where they can be contacted, allowing SPRY to use that information as means of contact. 

The collection, processing and transmission of data is carried out in a secure and encrypted way with SSL protocol and the security certificates are renewed every 90 days. You can verify that your browser is secure if the address starts with https instead of http.

 

The contact forms on this website do not store or analyze the completed data in any way. The data collected in the respective fields, the date and time of sending, are sent to info@spry.pt.

 

The available payment gateways, Paypal and Stripe, have their own privacy policies with respect to the information that we are required to provide for transactions related to your purchases on our website to be made. For these suppliers, we recommend that you read their privacy policies and find out how your personal information will be used by them.
